Probate Litigation – Will Contests
A will contest may be necessary when family members or other interested parties believe that a Last Will and Testament does not accurately reflect the wishes of the deceased. These disputes often arise when there are concerns about the circumstances surrounding the creation or execution of a will.
Common grounds for challenging a will include undue influence and lack of testamentary capacity. Undue influence occurs when an individual improperly influences another person to change or create a will for their own benefit. A will may also be challenged if the person signing it lacked the mental capacity necessary to understand the nature of their assets, the individuals who would naturally inherit from them, or the effect of the document they were signing.
Will contests can be complex, emotionally charged matters involving family relationships, medical records, and probate proceedings. Sullivan & Ward assists clients in evaluating potential will contests and provides experienced representation in estate and probate disputes throughout Iowa.
